| Summary of Issue | Officers have asked if the GVWR's are lower than the GCW or GVW at the time of the inspection with the CMV, which number should go into the inspection? The GVWR or the actual weight? 383.5 states whichever is greater (ratings or weight) will determine when CDLs will be required. Some MCSAP state investigators have said they like to see the actual weights put into the GVWR box if it puts the combination into CDL requirements for DACH reporting requirements. Some officers will only put the actual GVWRs instead of GVW as they don't want to make the courts or data think they are inaccurately reporting the GVWR's. |
| Justification or Need | Safespect only has GVWR for data reporting information yet when determining CDL's 383.5 states that GVW(gross vehicle weight) or GCW(Gross Combination Weight) which ever value is greater will determine CDL requirements. Courts and carriers have made arguments and dataqing violations stating the GVWR boxes show a no CDL required due to ratings. Yet, when the combination was weighed it showed actual weight was greater and inspector failed to include the weights in the notes. Having a GVW box next to the GVWR on the inspection will assist the industry seeing the different numbers side by side and why the CDL was required and will assist the courts on seeing this information as well. |
| Request for Action | Add two boxes next to each GVWR on safespect so the inspector, if they weigh vehicles, can add that information so GVWR rating info is maintained for proper data reporting and actual weight will clarify to support any no CDL violations. Only request to add if it is not a required field as alot of roadside inspectors do not weigh or are unable to weigh. |
