| Summary of Issue | CVSA Operational Policy 4 only allows Level I and Level V inspections to count towards passenger carrier initial and maintenance certification. |
| Justification or Need | Many jurisdictions have state mandated inspection programs for passenger carrying vehicles. These programs are not eligible for MCSAP funding and are conducted as a Level VII inspection. The Level VII inspections conducted on these vehicles are equivalent to a Level V inspection, however CVSA policy does not allow them to count towards passenger certification. Hundreds of these inspections are conducted each year, and by allowing Level VII inspections that meet CVSA policy and procedures to count towards passenger certification, state enforcement personnel will more efficiently be able to meet certification requirements. |
| Request for Action | Retitle CVSA’s Level I and II and V Passenger Carrier Vehicle Inspection Procedure title to Level I, II, V and Level VII Passenger Carrier Vehicle Inspection Procedure Update CVSA Operational Policy 4 in the following locations - 1. On page 8, bullet #2 in the Passenger Carrier Vehicle Inspection Certification section, change wording to the following: In addition to the training and testing requirements above, the inspector trainee must complete at least eight North American Standard Level I, Level V or Level VII Inspections, in accordance with the CVSA Level I, II ,V and Level VII Passenger Carrier Vehicle Inspection Procedure, on passenger carrier commercial vehicles with a certified inspector who will evaluate the inspector trainee for knowledge of the regulations, proficiency in the inspection process and documentation of violations. These inspections should be completed as soon as practicable, but no later than six months after passing the exam. Inspections conducted for initial certification cannot be combined. 2. On page 16, update the Passenger Carrier Vehicle Inspection section to the following: To maintain certification to conduct North American Standard Passenger Carrier inspections, an inspector shall, in addition to the “General Maintenance of Certification” section of Operational Policy 4, perform a minimum of eight North American Standard Level I, Level V or Level VII Inspections, in accordance with the CVSA Level I, II ,V and Level VII Passenger Carrier Vehicle Inspection Procedure, annually, for which the inspector alone takes credit. |
