Summary of Issue

During a recent roadside inspection, a vehicle was found to have one non-functioning service brake. Upon further investigation, the issue was traced to a temporary blockage within the air line caused by internal rust debris. The system passed a full function and leak test once cleared. The driver found all brakes to be operating as intended hours before during inspection & drained his air tanks prior to departure. The inspecting officer placed the vehicle out of service, citing CVSA brake criteria for inoperative brakes. I am questioning whether this classification is appropriate in cases where: The brake system remains mechanically intact, the failure is not due to worn, missing, or broken parts, the vehicle passes all standard air pressure and leak tests once the obstruction is cleared.

Justification or Need

I am writing to formally request clarification regarding the application of Out-of-Service (OOS) criteria in cases where a commercial vehicle's brake system is temporarily impaired due to a non-systemic, non-mechanical brake line blockage, such as: Rust flakes dislodging within the air line. Temporary ice blockage due to moisture and freezing temperatures. Debris causing a one-time restriction in air flow. In particular, I seek to understand how CVSA defines "inoperative brakes" when the failure is: Intermittent, not caused by broken or missing hardware, Corrected on-site without replacing brake components, Not indicative of systemic maintenance neglect.

Request for Action

Clarify whether temporary, non-mechanical brake blockages (caused by rust, freezing, or contaminants) meet the definition of “inoperative brakes” per CVSA OOS Criteria. Consider revising or qualifying the OOS brake definition to allow for on-site correction and return to service when the system is fully restored without component replacement. Provide guidance for enforcement officers to distinguish between mechanical brake failures and transient, field-serviceable obstructions. Thank you for your attention to this matter. I believe this clarification would help both inspectors and operators better align with the spirit of CVSA’s safety-first enforcement goals.
