Summary of Issue

A new operational policy is under development to outline the functionality of the CVSA Enhanced CMV Inspection program. During the development of the policy, suggested edits were identified in Operational Policy 5. Roadside inspectors should still consult the new policy for specific guidance on conducting inspections on vehicles participating in the enhanced inspection but general notifications for OOS and safety considerations for roadside inspectors would fall within Operational Policy 5.

Justification or Need

Roadside inspectors will likely need to contact a carrier official in the event of a roadside stop and/or inspection but the exact interaction necessary could change over time. Regardless of whether contact is always needed with a carrier official or not, any OOS Order should require that to be communicated to the motor carrier to ensure it is aware of the violation and can take the appropriate action to resolution the violation. Inspectors should also be made aware that they should not conduct an inspection on a vehicle with an automated driving system unless that system has been dis-engaged.

Request for Action

In the OUT-OF-SERVICE NOTIFICATION section of Operational Policy 5, add the following notification requirement to the list: “7. The vehicle is being operated by an automated driving system (ADS).” In the SAFETY CONSIDERATIONS section of Operational Policy 5, add the following to the list of considerations: “14. Always have the automated driving system dis-engaged before beginning an inspection on a vehicle equipped with an ADS system.”
