| Summary of Issue | In reference to CVSA issue request #14-009-VEH, regarding mudflaps touching tires, the Committee unanimously agreed it was not a violation and was a rare occurrence, so nothing was added to the OOSC, such as a note. The only place this information is known is through this 10-year old issue request. In recent weeks, this issue has come up more frequently and with newer inspectors who haven't been around for 10 years, they may not be aware of this issue. |
| Justification or Need | Vehicles are being declared out of service erroneously which costs time, money and resources at the scene, possibly including emergency repairs. Later, carriers are burdened with filing DataQs and states are burdened with handling DataQs. Carriers or drivers who do not know it is not a violation may be paying unnecessary fines. |
| Request for Action | Add a note to the OOSC regarding at the appropriate paragraphs (12.a.(8) for steer axle and 12.b.(4) for non-steer) mudflaps touching tires to avoid incorrect violations/OOS conditions. For example: NOTE: A rubber mudflap making contact with a tire is not a violation or out of service condition. |
