Summary of Issue

§ 393.83(d)(2) requires the exhaust system on a bus to discharge to the rear of all doors or windows designed to be open, except windows designed to be opened solely as emergency exits. Numerous buses are manufactured with an exhaust system that discharges to the side, middle of the bus directly under sliding windows.

Justification or Need

The carriers using these buses and inspectors are unsure if there's any allowance in such a circumstance where the exhaust was manufactured this way.

Request for Action

The request for action is determining enforcement guidance and if this is a violation or not. If it is a violation, could the carrier correct it by disabling windows from being opened except for an emergency exit?
