| Summary of Issue | The regulation for low air warning devices on air brake equipped vehicles has a conjunction that differs from the out of service criteria, which has caused some confusion among enforcement personnel. The US regulation reads, "55 psi AND below..." but the out of service criteria reads "55 psi OR below..." 49 CFR 393.51(c)(2): A warning signal that is audible or visible to a person in the normal driving position and provides a continuous warning to the driver whenever the air pressure in the service reservoir system is at 379 kPa (55 psi) and below, or one-half of the compressor governor cutout pressure, whichever is less. The 2023 CVSA out of service criteria, Part II, Item 1. j. Low Air Pressure Warning Device reads: Low air pressure warning device missing, inoperative or does not operate continuously if either the primary or secondary reservoir is 55 psi (379 kPa) or below, or 1/2 of the governor cut-out pressure, whichever is less. |
