| Summary of Issue | Question 9 in 395.2 has two different answers, depending on where you look. On the FMCSA website it directs a company to have their driver log hours used while on the yard as on duty not driving. In GUARD and in the regulation book, printed by Mancomm, each says to log the hours as on duty driving. If a company has drivers who operate on the roadway during the week but only operate on the yard during the weekend, never entering the roadway or moving freight, this could cause confusion and cause drivers to go over their hours to driver on duty. This could also cause an issue during a Compliance Review depending on which interpretation the SI looks at during the review. |
