| Summary of Issue | OOSC Part 1, sections 2(a)(2) and 3(a)(2) are to be followed and a driver placed OOS when a license is suspended for any safety related or unknown reason. |
| Justification or Need | Why are we permitting a driver to continue to drive when their license is suspended, regardless of the reason? Is there not a liability issue for the officer/inspector if the driver is allowed to continue with a suspended license and is subsequently involved in a serious crash. Officers/inspectors often spend additional time and resources in an attempt to determine safety related vs non-safety related, or no attempt is made at all and by default it is called an unknown reason and the driver is placed OOS. |
| Request for Action | Remove the reference to safety related reasons and make any suspended, revoked or disqualified license OOS regardless of the reason. If requirement cannot be removed then guidance and resources should be provided to assist in determining safety related or non-safety related. |
