| Summary of Issue | If a false log book is discovered on more then 1 day on an ELD or RODS, should separate violations be cited for each violation or once a log book is considered false should there only be 1 false RODS violation. In the past we have gone with the policy once a log is false the entire book is false. Given the guidance in Guard and everybody using electronic RODS, I don’t agree with that policy. I believe a false log violation should be documented for each 24 hour period if it is discovered and if it is an attempt to conceal HOS violation it should be OOS. Just looking for some guidance to give out to my staff. Should more then 1 false log book violation be documented on an inspection report? |
| Justification or Need | Clarification for field inspectors conducting roadside inspections. |
| Request for Action | Provide specific guidance in Operational Policy 14 as to how false log violations should be noted. Similar to the guidance for form and manner violations and driving violations. |
