| Summary of Issue | Recently, we have been finding more and more drivers that continue to operate after having been declared out of service for items such as being disqualified / no license, no / expired medical card and operating out of class. Carriers continue to operate while under a federal out of service orders. There needs to be an additional violation/penalty if the drivers and companies continue to operate after being declared out of service. |
| Justification or Need | With the increase in drivers and companies found continuing to operate after being declared out of service, there should be an added violation for operating after being declared out of service for anything other than hours of service or mechanical violations. |
| Request for Action | There needs to be an additional violation and penalty for drivers and carriers that have been placed out of service and continue to operate for items other than hours of service, mechanical issues and the federal OOS Orders outlined in Part IV. |
