| Summary of Issue | The clear identification and proper enforcement of Federal Out of Service Orders. The program (Query Central) currently used to check a company's credentials identifies if the company is under an Out of Service Order. However, Query Central does not identify if the Out of Service Orders applies to interstate operations only, or to both interstate & intrastate operations. Furthermore, the CVSA North American Standard Administrative Out of Service Criteria also fails to provide this very important information for the proper enforcement of these orders. |
| Justification or Need | The proper and efficient enforcement of Federal Out of Service Orders is essential to ensure unsafe motor carriers are removed from the roads to protect the motoring public. The officers taking enforcement action on these orders need to have complete and accurate information so that proper enforcement action is taken. Additionally, this information should be readily available to the roadside enforcement officers for officer safety purposes. Finally, improper enforcement of Out of Service Orders can be costly to industry partners and enforcement agencies. The motor carrier may be unjustly delayed and they vehicle may even be towed. The enforcement agency may be liable for a vehicle that is improperly towed due to the improper enforcement of these orders. |
| Request for Action | 1) Petition FMCSA to include a link to a PDF of the actual Out of Service Order on the "Carrier Summary Screen" in the Query Central Program for those companies that are identified as being under an Out of Service Order. 2) Request that language be added to the CVSA North American Standard Administrative Out of Service Criteria to specify which Out of Service Orders are applicable to Interstate Operation only, or to both Interstate and Intrastate operations. |
