| Summary of Issue | To amend the CVSA proposal regarding 49 CFR 395.2 term 'personal conveyance' as follows: \"Personal conveyance means an unladen motor vehicle, irregardless of it being commercial or non-commercial, used by a driver, while in an 'off duty status'and when the utilization of a motor carrier's motor vehicle is necessary for personal transportation,for a short distance.\" |
| Justification or Need | As it stands, the wording leaves out light duty vehicles which comprises a large bulk of many companies operations. The current regulation does not allow for any provision of \"off duty,\" thus mandating companies that allow light duty vehicles, used as personal conveyances for short distances, be annotated as \"on-duty not driving. This amendment would provide equal footing, regarding hours of service, for \"personal conveyance\" use for both cmv's and non'cmv's. |
