Summary of Issue

The CVSA North American Standard Out-of Service Criteria (OOSC), Interpretation #2, does not allow a driver to chain up an axle or single out a set of duals if one of the tires is flat or under inflated or has a rim problem, when it is inspected. But if the driver has singled out the duals and the weight carried does not exceed the tire's load limit before being inspected there is no violation. If there is no violation for a singled out dual before the inspection how can we require them to replace the tire or rim? Can they single out another set of duals on the truck or trailer to replace the one that was in violation? Interpretation #2 also states, This does not comply with CVSA Operational Policy 5 which states: \"No motor carrier shall require nor shall any person operate, or any inspector release any commercial motor vehicle declared \"out-of-service\" until all repairs required by the \"out-of-service notice\" have been satisfactory completed to where a violation no longer exits. ..\" If there is no tire weight rating violation with the duel single out, there is no longer a violation.

Justification or Need

We are requiring motor carriers to meet a standard that is not required by code. In many cases we are requiring them to purchase a tire or rim and the service to replace it roadside, when a commercial vehicle that enters the inspection area with a dual singled is allowed to proceed with no violation.

Request for Action

Remove Interpretation # 2 from the CVSA North American Standard Out-of-Service Criteria.
