Summary of Issue

Data Q challenges often take extended periods of time to get cleared up. If the challenge comes back anything other than an immediate - closed, no action taken - the process can take several months in some states. In the mean time, carriers are negatively affected by the scores, and the public assumes the violations are valid and correct.

Justification or Need

With more and more brokers and shippers looking at CSA profiles, it is even more imperative to make sure the data outlined is accurate and correct. Companies are losing business every day based on percentages that may not be a good reflection of that carrier's performance.

Request for Action

The withholding of the points assessment until a DataQ challenge has been fully adjudicated. As we discussed, any points assessed as a result of a roadside inspection impact the carries BASIC scores at the time of the assessment. If the carrier files a legitimate DataQ challenge, and succeeds, those points still impact the carrier’s BASIC scores during the DataQ challenge, which can take a significant amount of time to be completed. I’ve had experiences with successful DataQ challenges that have taken several months to be completed and in the meantime, our BASIC score was impacted for a violation that was later removed. My request is, would it be possible to have the violation points held in “abeyance” until a final decision has been reached on a DataQ challenge. If the carrier is unsuccessful in the challenge, then the points would be assessed at that time. If the carrier is successful, then no points would ever be assessed and the carrier’s BASIC values would not be impacted.
