| Summary of Issue | On October 26, 2011, the FMCSA published the Unified Registration System Supplemental Notice of Proposed Rulemaking. The rulemaking sets out to combine the USDOT Registration and Licensing and Insurance Registration Systems. Within that rule, the FMCSA proposed to inactivate the USDOT Number of those entities that fail to biennially update their registration information. The proposed language in the ANPRM added section 392.9b. That section follows: § 392.9b Prohibited transportation. (a) USDOT Registration required. A commercial motor vehicle providing transportation in interstate commerce must not be operated without a USDOT Registration and an active USDOT Number. (b) Penalties. If it is determined that the motor carrier responsible for the operation of such a vehicle is operating in violation of paragraph (a) of this section, it may be subject to penalties in accordance with 49 U.S.C. 521. The FMCSA is requesting that section 392.9b(a) be included in Part IV of the CVSA OOS Criteria. The proposed language for the OOS Criteria will be developed at a later date.
