| Summary of Issue | During a roadside inspection (approx 1 hour long), my driver was asked if he was wearing corrective lenses. He was wearing his sunglasses during the inspection and replied no (he was not driving during the inspection) but showed the officer that they were in his possession (on the dashboard). The officer cited him for being physically unqualified, placed him out-of-service and then allowed him to drive away after the inspection was over. I do not feel he should have been cited for being \"Physically Unqualified\" when his glasses were in his possession and shown to the officer. Furthermore, he should not have been placed out-of-service. Up until this inspection, my company has a 0% on out of service for both driver and vehicle. This one out of service took my company to over 12% (twice the national average). We are very serious about the safety of our passengers and the reputation of our company as evidenced by every inspection on the road and in our office. |
| Justification or Need | I have made a few challenges to the out-of-service on DataQs (challenge 160534) and they agreed to investigate it. Now they (AZ DPS) have come to the conclusion that the out of service will remain on my record. I do not understand how a driver can be placed out-of-service one minute and then be told he is free to drive off with passengers the next minute. |
