| Summary of Issue | With a recent review of roadside inspections using enhanced programs, related to CSA 2010 the following issue was learned. On January 23rd, 2010 our driver was inspected in Georgia. Two violations were noted on the inspection for the same issue. These violations were: (1) Section Code 40-6-48: Driver/Failure to maintain lane. Playing with CB Radio; (2) Section Code 40-6-241: Driver failed to exercise due care (distracted by CB radio)crossed white line. These violations were converted to the following: (1) Improper lane change (2) Reckless Driving. |
| Justification or Need | Due to scoring within CSA 2010, these two violations will not only cause issues with the carrier, but the driver as well. In the instance listed above, the violations were enhanced through this conversion. Meaning, the severity was increased. By the later violation being enhanced to reckless, the violation will not only cause issue with CSA 2010 scoring, but it will cause issues with company policies, PSP reports and cause the driver to be identified as a \"red flag\" driver. Secondly, did the initial violation actually meet the state definition of Reckless Driving? |
| Request for Action | Review the process with stakeholders, relating to violation conversions. Review current policies or guideance, relating to the conversions of violation codes. |
