| Summary of Issue | Use of securement devices other than lock pins and twists locks, 49 CFR 393.126(b)(1). Securement of intermodal containers transported on container chassis vehicle(s) states all lower corners of the intermodal container must be secured to the container chassis with securement devices or integral locking devices that cannot unintentionally become unfastened while the vehicle is in transit. In the unlikelihood that the container or integral locking device on the chassis cannot be used, a chain and chain binder is being used to secure the container to the container chassis. |
| Justification or Need | The regulation does not state specify what ?securement devices OR integral locking? devices must be used. If a chain and chain binder is used to secure the lower corner of the container the regulation has been complied with. Motor carriers, drivers, and IEPs are reporting this situation is being document as a defect on the roadside inspection report, placed out-of-service and being issued citations/tickets. |
| Request for Action | Issue a training or enforcement memo to jurisdictions for all roadside officers. |
