Summary of Issue

Based on work done by the ad-hoc committee on "How to Document a Violation" it was discussed and determined that based on how Cargo Securement is instructed and enforced that the current OOSC does not accurately reflect what should be documented when defective tiedowns are discovered. It was discussed that in cases where defective tiedowns are discovered, the vehicle is not placed out-of-service for the defective tiedown. The defective tiedown is subtracted from the total number of tiedowns and if the total remaining number is not adequate for either length or weight, the vehicle is placed OOS for inadequate number of tiedowns.

Justification or Need

It was determined that all the OOS conditions should be referenced and the defective tiedown should not be an OOS condition. When defective tiedowns are discovered, they are not included in the calculation for the weight or length requirements; therefore, it would be more appropriate to have all the defective tiedown guidance at the end of the section and a note indicating that tiedowns that meet this condition are not included when determining the weight and length requirements. It was also discussed that all the defective tiedown conditions should be included in one table similar to the current Defect Classification Chart.

Request for Action

Amend the North American Standard Out-of-Service Criteria (OOSC), Part II, Item 7 as per the attached document. The document removes edge protection as an OOSC as well as the defective tiedowns. It puts OOS conditions followed by the Defective Tiedown Table for reference of what constitutes a defective tiedown and gives direction that it is not to be used in the calculation towards the weight and length requirements. The cargo specific OOSC are still individually outlined at the end of the section, with a new subtitle for Commodity Specific Cargo and each commodity is individually specified with its own heading. The draft amendment is attached.
