Summary of Issue

It has been business practice that defects/violations that require multiple instances or a specified percentage to reach the level of OOS all such defects/violations that contribute to the OOS condition must be repaired before the vehicle is allowed back in service. However, there is no such statement or requirement of such described in the OOSC.

Justification or Need

There has been multiple incidents were the operator protested this business practice and in effect wanted to repair all but one defective brake so the total number of defective brakes was below the 20% threshold. This situation most commonly happens with the 20% defective brake OOSC, but there are other areas in the OOSC where this may be applicable (i.e. stop lamps, coupling, wheel fasteners, HM/DG placards, HM/DG ID numbers, etc.). In those situations where this has arisen, written policy regarding this business practice could not be found.

Request for Action

I'm recommending the Vehicle Committee examine this issue with consultation of the Hazardous Materials Committee and come up with wording to be placed in the Policy Statements of Part II and III of the OOSC.
