Summary of Issue

CVSA OPERATIONAL POLICY 5 requires raised lift axle componants to be inspected with the same requirements as other axles in use on the vehicle. Violations found are not to be considered for OOS action unless the axle is needed for weight carrying or a condition which could adversly affect vehicle operation. The policy is in conflict with 393.42 Interp. #1 and allows violations to be recorded on items which are not required unless in use at the time of inspection.

Justification or Need

FMCSR 393.42 Interp. 1 Guidence indicates that brakes on raised lift axles only need to work when the wheels are in contact with the roadway. Equipment on raised lift axles, which do not affect the operation of the vehicle at the time of inspection, should not be included as violations NAS inspection reports.

Request for Action

CVSA Operational Policy 5 regarding raised lift axles to be amended to indicate: raised lift axles are to be inspected to ensure all componants are secure and for conditions that could adversely affect the vehicles operation (air leaks).
