Summary of Issue

Conflicting OOS criteria for the same components. Part II - VEHICLE DESCRIPTION 9. SUSPENSION 9. a.(2) - Places a vehicle out of service when any axle positioning part allows an axle to shift. This would include loose bushings. 9. d. - Specifically excludes placing a vehicle out of service when a bushing is loose in a torque rod or tracking rod. When bushings are loose in torque rods and tracking rods, the axle will shift. Supporting documentation has been e-mailed to [email protected]

Justification or Need

It appears that Sections 9. a. (2) and 9. d. are inconsistent and in fact conflict. This has caused confusion for both enforcement personnel and the industry.

Request for Action

Amend Section 9. a. (2), by inserting the qualifying statement \"(Steering Axle Only)\" at the end of the Part 9. a. (2). a.(2) Any spring hanger(s), or other axle positioning part(s) cracked, broken, loose, or missing resulting in shifting of an axle from its normal position. (393.207(a)) "(Steering Axle Only)" Amend Section 9.d., by inserting the qualifying statement \"(All Axles Except Steering Axle)\" at the end of Part 9. d. Torque, Radius, Tracking or Sway Bar Components Any part of a torque, radius, or tracking component assembly or any part used foe attaching sane to the vehicle frame or axle that is cracked, loose, broken, or missing (including spring leaves used as a radius or torque rod, missing bushings but not loose bushings in torque, tracking rods or sway bars.) 393.207 (a)) \"(All Axles Except Steering Axle)\".
