| Summary of Issue | Performance Based Brake Tester OOS Criteria originally proposed in Savannah, Ga., October 2003. Executive Committee sent proposal back to vehicle committee to determine court support and identify logic tree to assist putting CMV back in service. |
| Justification or Need | Data from PBBT has been determined to meet the court evidence requirements of Frye, Daubert. Adoption of PBBT as an OOS criteria supports the CVSA mission to promote commercial motor vehicle safety by allowing more CMVs to be tested with fewer personnel. |
