| Summary of Issue | CVSA currently has a policy re: stacking of citations. Does this policy also include warnings? Example #1: A tractor-trailer is transporting 4 pallets of metal parts inside a dry van trailer. There are no load binders or any type of securement system present and none of the pallets are blocked, braced or secured to the vehicle. The vehicle is placed OOO and the inspector lists "improper securement system (tiedowns)" as the OOS, four times on the inspection report. The inspector is happy because he has padded his activity and his Sgt now loves him, but this inspection report, when entered, will indicate the carrier had 4 OOS violations, which will have an adverse affect on their safety rating. Example #2: A single-unit truck blows a fuse and all the marker, ID and clearance lights are inoperative. The inspector makes a separate violations listing on his report for each of the 14 affected lights (4 side marker, 6 ID lamps, and 4 clearance lamps.) |
| Justification or Need | Because of the far reaching Safety Rating implications, this stacking issue becomes even more important than stacking of citations. In the interest of fairness to the industry and uniformity of enforcement, is it acceptable to stack warnings? Is this a CVSA issue or does each member jurisdiction need to deal with this independently. |
