Summary of Issue

Can the Vehicle Committee confirm that there are certain vehicle defects/violations that a person does not see when conducting a Leve lII inspection. Drivers typically pick up a trailer or container chassis, that is neither the property of the carrier nor under its control, at an intermodal yard.

Justification or Need

The Vehicle Committee was not being asked about the carrier's legal responsibility. Currently, there is no question that carriers bear the legal responsibility for defective equipment found at roadside inspections. The question between carriers and intermodal equipment owners is what should the driver have discovered before entering the public highways.

Request for Action

All the Vehicle Committee is being asked is what a person might miss because of the limitations inherent in performing a Level II inspection.
