| Summary of Issue | Our inspectors see a need to add two more entries to the violation database used in SAFETYNET and ASPEN. The first entry would be for 392.5(a)(3), possession of alcohol, to distinguish this offense from 392.5(a)(2), using or being under the influence, even though the OOS criteria recognize use and possession as two difference violations. The second entry would be for 390.13, aiding or abetting a violation. There does not appear to be any entry at all for this violation in the database currently. |
| Justification or Need | To illustrate the reasons for this request, I will explain that we had a situation with a Canadian motor carrier on a trip through NH and VT, where the driver was both under the influence of alcohol and in possession of several bottles of alcohol which he was smuggling into Canada at the request of his supervisor. The state cited 392.5(a)(2), 392.5(a)(3) and 390.13 on the inspection report, but was only able to enter and upload 392.5(a)(2) using the 392.5A entry allowed by the database. These violations need to be added. |
