| Summary of Issue | The OOSC needs to be reworded to allow OOS when appropriate. Current Wording "is not accompanied b the holder of a valid CDL". Suggested "is not accompanied by and under the immediate supervision of another driver who is licensed to drive vehicles of the class then being driven by the holder of the learner's instructional permit." |
| Justification or Need | Inspections are being conducted on drivers who hold learner's permits and the co-driver is in the sleeper berth. Several drivers have produced instructional permits disclosing they have failed their skills tests. Supervision should be encouraged and demanded for these new drivers. CDL licenses of the same class should also be demanded by co-drivers so we don't have a Class B or C CDL driver instructing a Class A learner driver. |
| Request for Action | Change wording of the OOSC as above. The word "Accompanied" includes co-drivers in the sleeper berth. Including "under the immediate supervision of another driver," would solve this problem. Including co-driver with the same class of license, etc would solve the other problem. These changes would enhance a greater degree of safety to the general public and reduce vicarious liability to the companies. |
