| Justification or Need | We are seeking clarification on the abbreviations being used after the CFR 392.5 violation codes related to alcohol possession and operating under the influence. |
| Request for Action | As shown in the attached screenshot from a Georgia DPS inspection report, the abbreviation “DUI” is currently referenced for 392.5(a)(3) (possession of alcohol), while “IP” is referenced for 392.5(a)(2) (operating a CMV while under the influence of alcohol). Based on the regulatory language, it appears these abbreviations may be reversed? Specifically: • 392.5(a)(2) addresses operating a CMV while under the influence, which would seem more appropriately aligned with DUI, and • 392.5(a)(3) addresses possession of an intoxicating beverage, which may be better aligned with IP. This issue was first submitted by GA DPS to FMCSA Technical Support. FMCSA responded stating that the suffixes/abbreviations were submitted by CVSA and recommended that GA DPS submit an action request to CVSA. |
