| Summary of Issue | Currently inspectors do not have the ability to cite violations of 395.22(c) and 395.26(b) on Driver/Vehicle Examination Reports using the SafeSpect inspection platform. These violations are not available in SafeSpect. |
| Justification or Need | ELD account with an incorrect driver’s license state or number. 395.22(c) (I propose this be cited as a carrier violation as it is the motor carrier's responsibility to ensure the correct information is used when creating a user account. • Without this, there is no violation to address an ELD account with an incorrect license number. The correct license number is important for several reasons. o A driver is only allowed to have one license number. Using the correct license number as required reduces duplicate driver accounts. o A license state and number can be used to retrieve RODS transferred to eRODS. This is beneficial when a driver enters an incorrect file comment when transferring the log file. ELD not recording the vehicle miles driven, engine hours, odometer, geographic location, etc. – 395.26(b) • Without this, there is no violation to address an ELD that is not recording the required information because 395.8(f) can only be cited for drivers using paper logs or the equivalent of a paper log. |
