Summary of Issue

I would like some clarification in Operational Policy 14 concerning log book violations.

Justification or Need

Violations for form an manor are being added to inspections where driver's are placed out of service for not having RODS.

Request for Action

In the out of service criteria footnotes for no record of duty status it states that (8) If a driver is required to have an ELD and the vehicle is not equipped with an ELD, the driver is considered to have no RODS. I have co workers that write this violation and then write form an manor violations for the paper RODS. This seems improper to me and I would like clarification in operational policy 14 to address this scenario. Also, if there is a 60/70 hour rule violation on the paper RODS, but we listed them as not having RODS should we choose the violation with longer off duty required time? Should we ignore the 70 because they "do not have RODS"?
