| Summary of Issue | When a driver is inspected who does not have an ELD when required, but has a paper log and has violations in the log, the inspection software does not allow all appropriate violations to be recorded. |
| Justification or Need | All violations are required to be documented during a roadside inspection for consistency and to hold drivers/carriers accountable, as well as inform carriers of the issues so they can be addressed or corrected. In the case of a driver who requires an ELD, a violation of 395.8a1-ELD precludes the ability to enter a violation of 395.8(e) (false log), 395.8 (general form and manner violations), and 395.8(k)(2) (fail to retain previous 7 days). They are all valid violations for a driver who only has a few days of the required paper log, has falsified the log, and failed to complete the paper log pages as required (e.g., signature, address, name, miles, etc.) In those cases, the inspector can only enter the violations in the notes of the inspection, which may never make it to the motor carrier, and does not create an inspection history. This is not a hypothetical but from a roadside inspection with a driver on paper logs for more than 8 days, who required an ELD, in violation of both 11 and 14 hour rules, had a false log (admitted by the driver), and didn't complete the general form and manner requirements. The error screenshot provided when using the Iteris "Inspect" software occurs when a no ELD violation is entered and any other 395.8 violation is attempted to be entered (general form, false, no previous 7 days). |
