| Summary of Issue | There is nothing in the Out-of-Service Criteria to address carriers that are under a Federal Out-of-Service order for a "Denial of Access". |
| Justification or Need | When an inspector encounters a motor carrier that is under a Federal Out-of-Service order for a "Denial of Access". There is nothing that can be done to address this at roadside. This prevents the inspector from being able to take a potential unsafe carrier off of the roadway. States are also penalized by the FMCSA for failing to enforce the out-of-service order during a roadside inspection. |
| Request for Action | Please add this violation to the out-of-service criteria as quickly as possible. Doing so will help support the mission of the CVSA and the FMCSA by allowing inspectors to remove unsafe/non-compliant carriers from the roadway. |
