Summary of Issue

1) Multi state violations for improper name on side of vehicle. Misunderstanding of MCS 150 relationship between section 1 and section 2. In so, issuing violation for not having Legal name on side of vehicle. 2) Due to FMCSA limited space in section 2, DBA's are listed without space between or comma, dash. forward slash etc... 3) because of limited space in section 2, we cannot list all DBA's and currently FMCSA has stopped the update to their program, leaving us in a conundrum. We are in essence, being prevented from using our business model to further promote our organization to it's fullest potential. We purchase companies based on their market share and maintain the name in many cases. FMCSA and in respect to 390.21, we are currently being restricted from free enterprise by way of violating the FMCSR's

Justification or Need

Two things: 1) better roadside inspector understanding of the relationship between MCS 150 section 1 and 2 and understanding that there is no requirement for spacing of DBA names. 2) Assistance in pushing (petitioning) FMCSA to allow unrestricted characters in section 2 of the MCS 150. Therefor allowing a company to use its legal and justified business model to compete in the market place.

Request for Action

As listed above: 1) Guidance to officers on the requirements of 390.21(b)(1) 2) Assistance from CVSA to solve the problem with FMCSA with respect to limited character space under section 2 of the MCS 150 Form. In return would allow "all", Trade Names or DBA's to appear in Query Central at roadside. I ask that if used you protect our pertinent information - I can put together a Power Point Presentation for discussion at workshop.
