Summary of Issue

Issue with OOS Condition for Canadian Dangerous Goods Training Certificate - The note does not require the training certificate to be a "valid" certificate. In Canada a valid training certificate is one that has been issued within 36 months by the current employer. Also to define what "valid" means using the Operation Policy 15.

Justification or Need

Currently a driver producing an expired training certificate will meet the requirement to not be placed out of service as they would have produce a training certificate valid or not. Once valid is added to the note under Part I 3. COMMERCIAL DRIVER’S LICENSE (CDL) *c. Endorsements and Restrictions, we would like to define what is deemed a "valid" training certificate for the purposes of out of service condition. The purpose is to ensure there is an uniform approach to placing drivers out of service when producing a training certificate that may not have all the required information.

Request for Action

Two requests for action. The first is the add the word "valid" into the note section of Part I 3. COMMERCIAL DRIVER’S LICENSE (CDL) *c. Endorsements and Restrictions pertaining to Canadian drivers requiring to produce a dangerous goods training certificate. The wording is as follows: “Canadian operator’s license endorsements are included in the class. Transporting dangerous goods requires a valid training certificate. Declare driver out of service if not in possession.” The second request, is to add an FAQ to Operation Policy 15 regarding Canadian DG Training Certificates. The wording is as follows: 3. COMMERCIAL DRIVER’S LICENSE (CDL) *c. Endorsements and Restrictions What information must be included on a dangerous goods training certificate for a driver who is adequately trained? The North American Driver Standard Out-of-Service Criteria contain the notation “Canadian operator’s license endorsements are included in the class. Transporting dangerous goods requires a valid training certificate. Declare driver out of service if not in possession.” ANSWER: The information on a valid DG training certificate must include, for the purpose of this out of service declaration: 1. The name of the employer; 2. The employee’s name; 3. Evidence of the certificates date of issuance or expiry; 4. The aspects of handling or transporting dangerous goods for which the employee is trained. Note: The aspects of training identified must include the dangerous goods the employee is handling or transporting. 5. The signatures of the employer and the employee.
