Summary of Issue

Currently, the Out of Service Criteria states that a driver shall be placed out of service for "No skill performance evaluation in possession, when required." However, a driver that possesses a valid SPE but is not complying with the SPE requirements is not addressed in the Out of Service Criteria. For example, a driver possessing an SPE requiring a prosthetic limb, but is not using the prosthetic limb while driving, is not currently an out of service condition.

Justification or Need

High priority - The current OOSC allows medically unqualified drivers that fail to comply with their SPE to operate a CMV. The OOSC only specifically addresses drivers that fail to wear corrective lenses and/or hearing aids when required.

Request for Action

Please consider adding language to the Out of Service Criteria addressing drivers that fail to comply with the requirements of their SPE. Suggested Addition: Operating a commercial motor vehicle without complying with the requirements indicated on the Skill Performance Evaluation. (Declare driver out of service).
