| Summary of Issue | Currently, the Out of Service Criteria states that a driver shall be placed out of service for "No skill performance evaluation in possession, when required." However, a driver that possesses a valid SPE but is not complying with the SPE requirements is not addressed in the Out of Service Criteria. For example, a driver possessing an SPE requiring a prosthetic limb, but is not using the prosthetic limb while driving, is not currently an out of service condition. |
| Justification or Need | High priority - The current OOSC allows medically unqualified drivers that fail to comply with their SPE to operate a CMV. The OOSC only specifically addresses drivers that fail to wear corrective lenses and/or hearing aids when required. |
| Request for Action | Please consider adding language to the Out of Service Criteria addressing drivers that fail to comply with the requirements of their SPE. Suggested Addition: Operating a commercial motor vehicle without complying with the requirements indicated on the Skill Performance Evaluation. (Declare driver out of service). |
