Summary of Issue

Part 393.11. Back up lamp violations are being cited on tractor-trucks with trailers attached. This requirement is important when the vehicle is bob-tailing, but the back up lamp is ineffective and of no worth when the tractor-truck is attached to a trailer. This is the same concept as the \"license plate lamp in operative\" when the license plate is required to be on the front of the vehicle. Most roadside inspectors would exercise common sense with this however there are those who go word by word with the regulation to record a violation.

Justification or Need

The level of importance reflects the points that are assigned to the driver's (PSP) score(s) and the carrier's (SMS) values in the maintenance basic.

Request for Action

I am requesting that CVSA petition the FMCSA to amend foot note # 14 in the FMCSR's Part 393.11, to include the statement \"this does not apply to tractor-trucks when attached to any type full or semi-trailer.\"
