| Summary of Issue | Carriers, like Swift, call law enforcement for help when we believe we have a driver who may be under the influence while out on the roadway. FMCSA laws state the carrier cannot take action, under the FMCSA rules, unless the driver is in front of them and we make a direct observation. To help keep a possible impaired driver off the road we reach out law enforcement for help. But what happens is if the driver is found to be under the influence they punish the carrier by completing a DVIRs on the incident and damaging the carriers CSA score for doing the right thing. |
| Justification or Need | The is creating an issue where it may cause carriers to not look to law enforcement for help in an effort to protect their CSA scores. This not what the industry wants and we do not want possible impaired drivers on the roadways with our families. |
| Request for Action | Add an option in Aspen to indicate that the carrier notified enforcement and as a result, points will not go to the carrier. |
