Summary of Issue

Electronic Logging Devices(ELDs) or grandfathered AOBRDs will become mandatory for many commercial motor vehicles on December 18, 2017. Now that a new ELD rule has been published,it is necessary to determine what violation codes for ELDs will be used for citations, and what violations should be out-of-service (OOS). The OOS criteria will need to be in place on or before 12/18/2017.

Justification or Need

Due to the CVSA process for changing the OOSC, final decisions will need to be made quickly to have the ELD criteria in place by 12/18/2017. If the new criteria can be given a final vote by Fall 2016, they would be in effect on April 1, 2017. We suggest that they could be published then, but a delay in use until 12/18/2017 included in the approval.

Request for Action

FMCSA requests that the Driver & TE Committee discuss OOSC for ELDs at the April 2016 meeting and, if possible, develop and approve a list of the new OOS violations at that meeting. FMCSA will present suggested OOS violations at the time of the meeting in order to expedite the process.
