Summary of Issue

Cargo is flat rubber strips on pallets, with each pallet weighing approx 2000lbs, loaded in enclosed van trailer. The pallets were loaded down the center of the trailer but shifted during transit to the point the trailer was leaning to one side. My question is: Aspen says 393.100(c) is an OOS viol but it is not in the OOS criteria book. 393.100(b) is in Aspen as an OOS and also in the book but this code doesn't cover the prevention against shifting of load.

Justification or Need

This question has come up several times lately. The inspectors are placing this out of service because of the safety issue.

Request for Action

Have the OOS criteria book reflect Aspen with regards to 393.100(c) since product specific does not cover this type cargo.
