| Summary of Issue | Federal and State inspectors are seeing a noticeable trend, commonly involving Sprinter passenger vans, where carriers are utilizing unsecured, temporary seating such as folding chairs, foot stools, crates etc. in order to increase the passenger capacity of the vehicles. In one case, a van was found to be carrying 29 passengers yet the manufacturer's certification label specified 12 passengers as the allowable limit (see attached photos). |
| Justification or Need | Currently, the North American OOS Criteria does not specifically identify this practice as an OOS condition. |
| Request for Action | Recommend adding the following as an OOS condition. Detached or otherwise unsecured temporary seating, occupied or not, on a passenger-carrying vehicle. (393.93(a)(3)) |
