| Summary of Issue | Nevada is citing 393.13c1, No side retroreflective sheeting or reflex reflective material as required for hehicles manufactured before December 1993/reflective tape too high (>60") FM GRND. Our trailers are marked as received from the factory and as the norm in the tank truck industry. Mounting said reflective material at or no higher than 60" would render the reflective material ineffective and not visible to on-coming motorists |
| Justification or Need | By enforcing this regulation exactly as written, the use of reflective material on the side of most tank trailers would become a useless act and the possibility if not actual side impacts of tank trailers by other motorists deprived of the view of reflective material mounted exactly per the regulations would dramatically increase! |
| Request for Action | The regulation should be reviewed for its practical application with respect to tank trailers. Officers should be trained to enforce regulations while at the same time using common sense. |
