Summary of Issue

393.130(b)(1) states Accessory equipment, such as hydraulic shovels, must be completely lowered and secured to the vehicle. Paragraph (c) states, In addition to the requirements of paragraph (b)......There are carriers arguing that the accessory equipment tiedown should be used in calculating the weight requirements for tiedowns. This is not the intent of the regulation if I am correct.

Clarification or interpretation of the regulation.

Request for Action

I would like to have something in writing stating \"This tiedown is not to be included in calculating the weight requirements of the load\" or something to that effect. If it was clarified there would be no argument with carriers or a judges opinion in court.
