| Summary of Issue | In Part I of the North American Standard Out-of-Service Criteria (OOSC) as amended on April 1, 2009 to include: "Operating a passenger-carrying vehicle without possessing a valid medical certificate." For many years Part I of the OOSC has stated in regard to CDL: "Does not possess a valid CDL." Both of these OOS conditions use the word "possess", but the word has different meaning for each situation. |
| Justification or Need | I believe using the word "possess", in both of these violations leads to confusion. |
| Request for Action | Request CVSA to amend the wording in Part I of the OOSC, 4. Driver Medical, b. Medical Certificate to: "Operating a passenger-carrying vehicle without A VALID MEDICAL CERTIFICATE IN POSSESSION." I would like to see no operator's license (CDL and Non-CDL) "IN POSSESSION" an OOS condition also, but I have no supporting documentation for that request. |
