| Summary of Issue | Need to add 383.23(c)(2) and 383.23(c)(3) to the CDL out-of-service criteria, under Item 3b in Part I. In (c)(2), the FMCSRs require a valid state automobile driver?s license in order for the learner?s permit to be valid. In (c)(3), the regulations also prohibit operation of a commercial motor vehicle transporting hazardous materials on a learner?s permit. |
| Justification or Need | This information came out of the Driver/Traffic Enforcement Committee Workgroup in Pursuit of Inspection Data Quality. These violations are serious safety concerns and should be added to the North American Standard Out-of-Service Criteria (OOSC). |
