Summary of Issue

Indiana has many interstate and intrastate for hire passenger carriers who are utilizing 9-15 passenger vans towing trailers. These carriers number in the 100s and while have been on the outlying areas of enforcement, issues this past spring brought their operations to our immediate attention.

Justification or Need

These for hire carriers were mostly operating outside Indiana laws and the FMCSRs. We addressed the issue this spring after a few terminal inspections. ISP chose to educate to try to encourage compiance and in some cases we were succesasful. ISP promised to return after enforcement was relaxed to give carriers time to meet the Indiana State laws and the FMCSRs. The time for strict enforcement has come and ISP-CVED needs to inspect many for hire passenger carrying CMVs.

Request for Action

Unfortunatly, ISP CVED only has 11 CVSA Certified Passsenger Carrying inspectors statewide. We understand that for Level Is we would need to utilize them for this type of inspecitons, however, the type of inspections needed are for Level IIIs not Level Is. Since the Level III inspeciton is a driver inspection only and our need is mainly for licensing, credentrialing and registrations for Indiana law and FMCSRs. We would like to utilize our CVED personnel who are Level I certified and certain Non-Division Trooper personnel who are Level III certified to conduct Level III inspections on these for hire interstate and intrastate passenger carriers.
