| Summary of Issue | During a recent inquiry of critical items, I found two answers to the following question: Q. At the completion of an NAS Level I inspection the only defect noted is one ID lamp not working. Does this vehicle qualify for a CVSA decal? A #1 Yes, because the violation does not lead to out-of-service. A #2. No, because the defect is considered a critical defect violation. It appears that this answer differs from jurisdiction to jurisdiction. |
| Justification or Need | CVSA has always been an organization that provides uniformity. The industry has worked hard to police itself and maintain CMVs in a safe operating condition and is entitled to the CVSA decal, in a uniform manner, when meeting such criteria. |
| Request for Action | Issue needed clarification: Would ANY component found to be defective during an inspection that would fall under one of the headings of the critical item list considered a critical item violation and the vehicle would not qualify for a CVSA decal? |
