Summary of Issue

During a recent inquiry of critical items, I found two answers to the following question: Q. At the completion of an NAS Level I inspection the only defect noted is one ID lamp not working. Does this vehicle qualify for a CVSA decal? A #1 Yes, because the violation does not lead to out-of-service. A #2. No, because the defect is considered a critical defect violation. It appears that this answer differs from jurisdiction to jurisdiction.

Justification or Need

CVSA has always been an organization that provides uniformity. The industry has worked hard to police itself and maintain CMVs in a safe operating condition and is entitled to the CVSA decal, in a uniform manner, when meeting such criteria.

Request for Action

Issue needed clarification: Would ANY component found to be defective during an inspection that would fall under one of the headings of the critical item list considered a critical item violation and the vehicle would not qualify for a CVSA decal?
