| Summary of Issue | I serve as a safety/loss control consultant working with fleet accounts across the country. One of my accounts is an explosives hauler who operates vehicles within the State of Montana. These speciality vehicles will carry deisel, fertilizer, and explosives in one vehicle (called a Triple-Threat) used in mining, etc. During a recent safety meeting I learned that their trucks will on occasion be asked to pull into enclosed DOT inspection stations. These stations do not have explosion-proof lighting, and the lights end up being fairly close to the tops of their trailers. They have attempted to sway the inspectors to not inspect them inside these locations, and are told they will be shut down if they don't pull into the inspection station. This is an unsafe situation. What are the rights of the driver and/or inspector to place persons in danger in a situation such as this? I will look forward to your response. |
