| Summary of Issue | Currently a driver is placed OOS for 10 hrs for no log book in possesion. I suggest that the driver should be placed OOS for 34 hrs. This would ensure that the driver would be in compliance if he was in fact over his hours but knows that you can only put him OOS for 10 hours by stating he does no have a log book. The 10 hours off duty is used when a driver has been achieving his required 10 hour rest periods. We have no way of knowing if the driver has been in compliance with his hours of driving time and rest options. |
| Justification or Need | I feel this is a problem that is expanding due to the industry is very knowledgable about how many hours we can place them OOS. The problem driver who is the one we are trying to remove from the nations roadways are the ones that are benefitting from the 10 hours OOS rule. |
| Request for Action | The driver not in possession of a log book should be treated as a major violation not a minor 10 hours OOS violation as it currently is. |
