| Summary of Issue | Our drivers received a HMOOS when hazmat in a sealed container was found to be improperly blocked and braced. The shipper loaded the container and certified compliance. We are requesting the OOS be removed. |
| Justification or Need | (see letter of interpretation 9-2-1994) I am requesting clarification on why the responsibility for compliance is with the person loading (shipper), but the punitive action is against the carrier. |
| Request for Action | Our security and company policy prohibits drivers from breaking seals on containers. The shipper must follow & certify compliance with regulations, if the shipper has not properly blocked and braced hazmat within the container, they should be accountable. |
